UK – Terms and Conditions for New Generation Ski and Snowboard Limited
Introduction
These Terms and Conditions, set forth by New Generation Ski and Snowboard Limited (hereinafter referred to as “New Generation”), govern the provision of package trips, including but not limited to sports coaching, guiding, accommodation, and transport, excluding flights, to our clients. By booking a package with New Generation, you agree to be bound by these Terms and Conditions, which are designed in compliance with UK Law, including the Package Travel and Linked Travel Arrangements Regulations 2018.
Booking and Payment
A booking is confirmed upon receipt of a deposit or full payment from the client.
Full payment is required at least 90 days before the start date of the package.
Cancellation Policy
New Generation acknowledges that plans can change. Our cancellation policy is designed to be fair and clear to our clients and our team.
- More than 90 days before the start date: Full refund minus a 5% administration fee.
- 45 to 89 days before the start date: 50% refund of the total cost.
- Less than 45 days before the start date: No refund available. However, should we manage to resell your space or recoup any costs associated with your booking, we’ll refund these amounts.
Programme Alteration or Cancellation by New Generation
New Generation reserves the right to alter or cancel any programme due to unforeseen circumstances. In such cases, clients will be offered a full refund or the option to reschedule. Any alterations will aim to provide an experience of equal or greater value.
Insurance
We strongly recommend that all participants have comprehensive travel insurance that covers cancellations due to personal circumstances, as well as medical expenses, loss of luggage, and other travel mishaps.
Liability
New Generation will not be liable for any loss, damage, illness, injury, or death that may occur during the use of our services, except where it is caused by our negligence. We ensure that all services provided meet the local standards and laws of the host country.
Pre-requisites
Age Requirement: Students must be at least 18 years of age on the first day of the course.
Health and Fitness: It is the student’s responsibility to ensure they possess the required health and fitness levels for the duration of the course. New Generation will not provide refunds if students are unable to continue with training due to health and/or fitness levels.
Medical Conditions: For safety and insurance reasons, students must notify New Generation of all pre-existing medical conditions and health issues that could impact their ability to safely complete the programme.
Residential Course Requirements:
Students enrolled in residential courses longer than two weeks must provide a £500 damage deposit to New Generation as security against any damages incurred to course accommodation.
Visa Requirements: It is the student’s responsibility to secure any required visas. Failure to obtain a visa does not entitle the student to a refund in line with our cancellation policy.
Operational Interruptions:
If the resort is open (or partly open), services will be delivered as planned to the extent available. Interruptions in resort operations are outside our control and will not entitle students to reimbursements, compensation, or discounts.
Force Majeure:
New Generation shall not be liable for failure or delay in performing its obligations due to events beyond its control, including but not limited to Acts of God, war, epidemic, government intervention, strikes, and criminal conduct by the participant. No refunds will be provided in the event of Force Majeure. This does not affect your rights under the Package Travel and Linked Travel Arrangements Regulations 2018.
Alcohol Consumption and Drugs:
Trainees must not consume alcohol before training sessions. Those found intoxicated or under the influence during training will be removed from the course.
Possession or use of illegal substances will result in immediate removal from the course.
General Conduct:
Trainees are expected to maintain professional conduct throughout the course. Unprofessional or antisocial behaviour, including verbal abuse, ignoring instructions, threatening behaviour, and property damage, may result in removal from the course.
Complaints
Any complaints should be addressed to New Generation as soon as possible during your trip. We’re committed to resolving issues efficiently and to the satisfaction of our clients.
Data Protection
New Generation is committed to protecting your privacy and ensuring the security of your personal information in compliance with the General Data Protection Regulation (GDPR).
Governing Law and Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of the United Kingdom. Any disputes will be subject to the exclusive jurisdiction of the UK courts.
Amendments
New Generation reserves the right to update or alter these Terms and Conditions at anytime. Any changes will be effective immediately upon posting to our website. You will be bound by the terms and conditions in use at the time of your booking which can be found on your confirmation email.
